I think there is often a matter of design and innovation. In
biomedicine, we see this every day. For instance, a set of
common lab chemicals are bottled together as a convenient kit
and the kit is sold as a patented product.
And then, there are the obvious mutations of proteins, etc that get
patented into new drugs, sometimes years after it was published
and everyone knew about it. I guess sometimes people violate these
patents claiming the item was not patentable, and maybe rightfully
so.
