Really?  Doesn't that apply ONLY to copyrights after 1977?

Funny how you didn't say anything from § 304! That is the pertinent part, I 
believe. It has to do with works copyrighted BEFORE 1978, and it is even 
more tricky than the newer copyrights. Ellison's death might have nothing to 
do with it. There would probably be copyright extensions given to the 
publishers of the ATM books or his heirs. I would start by asking who has 
the copyright to the ATM books, and contact them.
