True or no, it cannot be legal.

What I do know from Adobe directly is that if you have ANY legit copy of 
PS, no matter what version, you can pay the $150 upgrade fee and go 
straight to v.7.0 which is what I will do - got a copy of 3.0 for $50 
and called and they confirmed I can upgrade.

A legal alternative and still a heck of a deal.
